“Nawaz should quit politics following Asghar Khan case verdict” – Imran Khan"

LAHORE: Pakistan Tehreek-e-Insaf Chairman Imran Khan has stated that Nawaz Sharid should quit politics following the verdict announced by the Supreme Court with respect to the Asghar Khan case.
Talking at the 11th Internation Cancer symposium on Friday, Imran said that he himself would quit politics if it is proved that he received any money from the Inter-Services Intelligence (ISI).
Talking about President Zardari, Imran stated that Zardari’ stance did not seem neutral following the Swiss case decision.
Imran attested General Kayani’s statement whereby the Chief of Army Staff had stated that institutions should act within their limits.
The Asghar Khan case verdict has shaken the political arena after the Supreme Court declared that the general election held in the year 1990 was subjected to corruption and corrupt practices as in view of the overwhelming material produced by the parties during hearing it had been established that an “Election Cell” had been created in the Presidency, which was functioning to provide financial assistance to the favored candidates, or a group of political parties to achieve desired result by polluting election process and to deprive the people of Pakistan from being represented by their chosen representatives.

"Asghar Khan Case: SC orders action against Baig, Durrani"

ISLAMABAD: The Supreme Court on Thursday issued detailed verdict in Asghar khan case ordering action against Former Director General ISI Lt Gen (retd) Asad Durrani and Former Chief of Army Staff Gen (retd) Aslam Baig.
Last month the court announced its short verdict, in which declared that the general election held in the year 1990 was subjected to corruption and corrupt practices as in view of the overwhelming material produced by the parties during hearing it has been established that an “Election Cell” had been created in the Presidency, which was functioning to provide financial assistance to the favoured candidates, or a group of political parties to achieve desired result by polluting election process and to deprive the people of Pakistan from being represented by their chosen representatives.
The court ordered FIA to investigate the case and collect all the money with the interest rate from intelligence agencies including ISI and MI.
The court ruled that both Durrani and Beg brought a bad name to Pakistan and its armed forces as well as secret agencies in the eyes of the nation. “Notwithstanding that they may have retired from service, the federal government shall take necessary steps under the Constitution and law against them,” said the short order.
The court also ordered the initiation of legal proceedings against the politicians who allegedly received donations to spend on election campaigns in 1990 and directed the Federal Investigation Agency (FIA) to conduct a transparent investigation on the criminal side against all of them and if sufficient evidence was collected, they should be sent for a trial according to the law.

22 dead in Indian floods; 60,000 displaced: official

Torrential rains in the southern Indian state of Andhra Pradesh have killed at least 22 people and displaced tens of thousands of villagers over the past week, an official said Monday.

Downpours triggered by a cyclone that hit the coast last Wednesday near Chennai left hundreds of villages inundated and 60,000 people in relief camps, Karikal Valaven, a government officer overseeing emergency operations, said.
“At least 22 people have died and thousands have lost their houses. The rains have damaged all the standing crops in the coastal region,” he told AFP.
Disaster response teams helped move people to higher ground in rubber boats and nearly 100 shelters were opened across the state to accommodate people fleeing the flood zone.
“The unseasonal rainfall has destroyed our crops and our entire field is submerged in water,” Arku Rajaipa, a farmer in Guntur district, one of the worst-affected regions, told a local TV news channel.
“We will have to depend on the government for food the whole year.”
Cyclone Nilam struck 50 kilometres (30 miles) south of Chennai last week in the neighbouring state of Tamil Nadu before moving inland, killing at least 10 people.
The Andhra Pradesh state government said in a statement that it had handed out 100,000 food packets.
Authorities on Monday said many villages had been cut off for days.
“The biggest task is to establish contact with 130 villages. They are safe but have suffered big losses as all their rice crop has been destroyed,” Valaven said.
All trains were suspended from the coastal cities of Visakhapatnam and Vijaywada, a major transit route in the region.
The meteorological office has forecast more rain, and people from low-lying areas have been advised to head to shelters.
In September two million people were forced to flee their homes in the north-eastern state of Assam after floods triggered by heavy monsoon rains.

More arrest warrants issued for Yar Rind

 Staff Report

QUETTA: Former federal minister was barely out of hot waters after the court approved his bail in kidnapping case, when Balochistan police issued his warrants in eight other cases, SAMAA reports Monday.

Balochistan police handed over to Islamabad police the warrants for the arrest of Q-League leader from Balochistan. Police officials are in consultations over the issue.

It should be mentioned here that apex court granted the bail to the former federal minister from Balochistan Yar Muhammed Rind against two surety bonds worth five lakh rupees in kidnap case.

The apex court directed the concerned authorities not to arrest him again unless his involvement is found in any other case.

Deputy Prosecutor General Azam Khattak told the court that the prosecution record could not be retrieved owing to the lack of time.

Heading a three-judge bench hearing Rind’s appeal, Chief Justice of Pakistan (CJP) Iftikhar Muhammed Chaudhry stressed on the status of a penalty delivered in absentia, adding, “We discouraged the in-absentia punishment in the National Reconciliation Ordinance (NRO) verdict.”

Counsel for Rind, advocate Akram Shaikh said the case against his client is the result of tribal hostilities and owing to the same enmity, Rind could not attend the trial court all this meantime.

Sheikh pleaded the court to transfer the case to some other location, as his client’s life is in jeopardy in Balochistan.

It is pertinent to note here that Leader of the Opposition in the Balochistan Assembly Rind was arrested on Thursday (November 1) at the behest of the Supreme Court as he appeared before the court.

It may be noted here that the trial court and Balochistan High Court (BHC) awarded life imprisonment to Yar Muhammad Rind in a murder case. He had not been appearing in the provincial courts for many years. However, he had filed a petition in the apex court against his imprisonment order.

During the previous hearing, the three-member bench of the court, hearing Rind’s appeal, ordered the arrest of Sardar Yar Mohammad Rind as per the requirements of law. –

CJP orders probe into Tayyaba Zameer's son's death

SARGODHA: Chief Justice of Pakistan has ordered a probe into Pakistan Muslim League-Nawaz MPA, Tayyaba Zameer’s son’s death, Geo News reported.
This heartening incident of justice on-the-go came to pass while Chief Justice of Pakistan, Justice Iftikhar Mohammad Chaudhry was visiting Sargodha Bar.
According to reports, Tayyaba Zameer, showed up at the ceremony the CJ was attending and tried to approach him directly, but security intervened. When the CJ noticed her struggling to reach him, he ordered the cops to let her through. She then sat by his side and had a detailed word with him, the sources added.
MPA Zameer pleaded before the CJ that her son, Zil-e-Subhan, 27, had died in a hospital under mysterious circumstances and that she was sure he was killed.
After hearing her out, the CJ directed the authorities concerned to reopen the case and launch an in-depth investigation to find out as to what and who caused her son’s death.
In her entreaty she alleged that the doctors on duty then neglected her son to death, thus it was a murder.
The shocking revelation had come to surface back in June during the PA proceedings after Tayyaba Zameer, one of the most senior and loyal members of PML-N, on a point of order burst into tears while disclosing that her only son 27-year-old Zil-e-Subhan died in Ganga Ram Hospital, where he was shifted after the administration of Services Hospital refused to provide him with ventilator.
Tayyaba Zameer, who hails from Sargodha, said she was not the only mother who had undergone this turmoil as the doctors of Services and also Ganga Ram Hospitals were playing havoc with human lives and treating them as animals were treated in the slaughterhouses.
Disclosing further details, she said that her son was admitted in the Services Hospital for medical checkup but doctors did not cooperate with her despite knowing that his health was deteriorating.
She also said that when the health of her son further deteriorated and a ventilator was needed, she went to the administration and asked for it but she was refused and a doctor even said ‘is it a wooden box which we should hand over to you.’
Naming a doctor, Usman Cheema, she said this man not mishandled the case of her son but also misbehaved with her and used abusive language against her.
Tayyaba Zameer also told that later the patient was shifted to Ganga Ram Hospital where a team of doctors deliberately mishandled the case, which resulted in the death of her son, Subhan.
She said that it was a pity that even being an elected member of the House, she was unable to get justice and a calamity had befallen her in the form of the death of her only son.

NAB prevents RPP Karkey from leaving Pakistani waters

ISLAMABAD: The National Accountability Bureau (NAB) has directed the Maritime Security Agency and Port Qasim authorities to prevent the rental power plants Karkey from crossing the Pakistani sea limits Saturday, Geo News reported.
According to sources, NAB would seek the Supreme Court’s approval before allowing the ships to leave for their respective country.
NAB had earlier allowed the four Karkey ships to leave the country but according to the SC order, M/s Karkey has to refund the advance and other pending amounts due to which the rental power plants have now been barred from leaving the country.
The Transparency International had reported a mega corruption scandal of the present times to the prime minister in which the NAB allegedly cleared one of the rental power plants without recovering $220 million from it.
The corruption watchdog had requested Prime Minister Raja Pervaiz Ashraf to take notice of this huge embezzlement done in connivance with the NAB where M/s Karkey RPP has been allowed to leave Pakistan without paying the recoverable money.
Interestingly, the name of PM Ashraf is also among the accused persons in the RPP cases. Transparency has warned that if M/S Karkey were allowed to leave Pakistan, then all recovered amount in the RPP case would have to be refunded to others as well.
According to the orders of the Supreme Court announced on March 30, 2012 in the RPP case, besides other actions, the court directed the government to take the following action to recover all payments made to the RPPs with mark-up, who had failed to achieve CoD within the stipulated time; “Para 84 (vi) The Ministry of Finance, WAPDA, Pepco as well as Gencos are responsible for causing huge losses to the public exchequer, which run into billions of rupees by making 7% to 14% down payments and purchasing electricity on higher rates, from RPPs, therefore, steps are required to be taken to effect recovery of the amounts with mark-up outstanding against the RPPs whose contracts have been signed off or who had failed to achieve CoD within the stipulated time in terms of the performance guarantees”.
Another paragraph number 38 is quoted below; “38. Mr. Kamal Anwar, ASC assisted the court as Amicus Curiae. He submitted that advance payment was made to 9 RPPs, namely, Karkey, Gulf Rental Power, Reshma Power, Techo Sammundri Road Faisalabad, Techno Sahuwal Sialkot, Guddu, Young Gen, Naudero-I and Naudero-II, details whereof have been given hereinabove. None of them could achieve CoD within time, on account of which their contracts were signed off. Statedly, the bank guarantees furnished on behalfof all the bidders have also been encashed. Out of said RPPs, the advance payment was returned by Reshma, Techo Sammundri Road Faisalabad, Techno Sahuwal Sialkot, Guddu, Young Gen and Naudero-II. However, Karkey (231.8 MW), Gulf (62 MW), Naudero-I (51 MW) and Reshma (201 MW), which are still functioning, had achieved delayed COD.”
Transparency has calculated the recoverable amount paid to M/s Karkey, which is estimated to be $220 million. ‘Accordingly, recovery from Karkey RPP which failed to achieve CoD within the stipulated time, works out to be approximately $220.76 million. Karkey was paid 14% advance $79.05 million; $7.654 per month from April 2011 to March 2012 ($91.84 million); Total to be repaid by Karkey is $170.89 Million; Bank interest for 3-1/2 years on $79.05 million is about $45 million, and for 1 year on $91.84 million is $12.87 million so the total recoverable amount from Karkey Power Plant is therefore $220.76 million’, Transparency has apprised the PM.
